2001 Law
Information about the Data Protection (Bailiwick of Guernsey) Law,2001
The Law is intended to bring the level of protection within the Bailiwick up to an adequate standard to ensure the free flow of personal data within Europe and worldwide.
The Projet de Loi available for download from this site is believed to be an accurate copy of the Law; the definitive copy of the Law is obtainable from H.M. Greffier at a cost of £15.
The first 16 Statutory Instruments giving effect to the Law were made by the Advisory and Finance Committee on 9th July 2002 amd were laid before the States, enabling the Law to come into force on 1st August 2002.
A copy of the Rules of Court specifying the procedures for appeals under section 48 of the Law and for National Security Appeals are avaiable for download from this site. These are believed to be accurate copies; definitive copies of these Rules are obtainable from H.M. Greffier.
The Law features an on-line notification system that is designed to be less bureaucratic than registration under the old [1986] Law.
